The Copyright in this and any commissioned Websites and the source code of individual pages is owned by BOARD. After receipt of the final payment, the BOARD assigns to the Client the right to use the completed Website as a Website without further payment. The copyright in individual items such as text, photographs, images etc. remains the property of their respective owners, and is not transferred to the Client. Uses other than as a Website may require the consent of the relevant copyright holder.
Assignment
BOARD reserves the right to assign or otherwise subcontract all or part of any commission.
Delivery time
BOARD will aim to have its commissions completed within the advertised time frame, and warrants to use its best endeavors so to do. However, BOARD will not be held responsible for delays or omissions caused by a failure of the Client to comply with the workflow or these terms and conditions, nor for circumstances outside BOARD’s control.
3rd Party Service Providers
BOARD may, as part of the work undertaken, arrange the engagement of an Internet Service Provider on behalf of the Client. BOARD only uses extremely reliable and secure hosting networks. However BOARD gives no warranty either express or implied as to the frequency of accessing the Website by visitors or the periods of availability of the Website to visitors, neither of which is within the BOARD control. BOARD will not be liable to the Client or any third party for any damages, including loss of profits or consequential damages arising out of either the operation or in operation of the Website.

Links to other sites are made at the client’s own risk and BOARD accepts no liability for any linked sites. When you access a non-BOARD third party web site, please understand that it is independent from BOARD and BOARD has no control over that web site and the link does not mean that BOARD endorses or accepts any responsibility for the content or the use of such web site.
Limitation of Liability
To the full extent permissible by law, BOARD assume no responsibility or liability for any information published on this or any commissioned website and further disclaim all liability in respect of such information. In particular, BOARD hereby excludes all liability for any claims, losses, demands or damages of any kind whatsoever in relation to any information, content or advertisements.

CLIENT OBLIGATIONS:
Obligations of the Client
To provide BOARD with access to sufficient information to allow any commission to be implemented, and to provide passwords and authority, if required, by the Client's Internet Service Provider to allow BOARD to upload Web pages into the Clients Web space and otherwise ensure satisfactory operation of the Website.
The Client will not allow, permit or require the design to include, publish, link to or otherwise broadcast or disseminate, whether directly or indirectly, any material that is indecent obscene immoral offensive defamatory or otherwise unlawful in any form whatsoever and should BOARD at it’s sole discretion consider the Client to be in breach of this condition or any part thereof, BOARD may terminate the Project Agreement without compensation to the Client.
The Client agrees to pay all taxes and tariffs pertaining to products and services that may be sold from the Website and indemnifies BOARD against all liability in this regard in respect of the Client's electronic commerce activities.
The Client will also be responsible for obtaining and holding all consents licenses permits and other similar instruments applicable to material it supplies to BOARD for incorporation into the commissioned Website. This will include without limitation copyrights trademarks logos patents and all such similar instruments.
Copyright
Client must ensure that they retain the copyright to all data, graphics, and files provided to BOARD and grants BOARD the rights to publish and use provided materials. Custom files, graphics and logos designed by BOARD for use in the client’s site will remain the property of BOARD.
Termination
Termination of services by the client must be in the form of a written request. email or telephone requests do not constitute termination of the commissioned services. Site Design and Hosting Packages a for a fixed one year contract.

PAYMENT TERMS:
Quotation
The fees for design services provided by BOARD will be quoted via email once the client has stated the requirements of the site. Quotes to the client by BOARD are valid for thirty days after the quotation date, after thirty days charges may be subject to change at the discretion of BOARD. Agreed quotations secure rates until the quoted commission is completed.
Deposits
BOARD may require a 100.00€ deposit in advance of starting a commission to cover domain name purchase and hosting. In this instance BOARD will provide PDF email invoices to the client. Payment for the initial deposit must be received in cleared funds before any work can commence and is non-refundable.
Invoices
Upon completion, the Client will be issued with an invoice for any outstanding balance via PDF email. Payment for the outstanding balance must be received in full within thirty days of the invoice date.
If the balance is unpaid after thirty days, all design material becomes the property of BOARD, with exception to client -copyrighted material, and the account will be considered to be in default. Clients with accounts in default agree to pay BOARD all reasonable expenses incurred to collect outstanding charges. If the balance is unpaid after thirty days, BOARD also reserves the right to cancel all services.

Pricing
Price excludes tax, other than that, no hidden costs.
Delivery Time
This is the time frame we aim to complete your site within, though in many cases we’ll have it designed and on-line even quicker . Delivery time is valid from the time we receive all required material from the Client
FREE .com (or similar) domain name registration!
We’ll search and register your domain for FREE! Domain suffixes included: .com, .co.uk, .org.uk, .me.uk, .ltd.uk, .plc.uk, .eu, .com, .org, .net, .biz, .info, .us, .name. Alternatively if you require a domain with another suffix this is chargeable.
Domain Ownership
You get to keep the domain name, whatever.
1 Years FREE secure hosting
We only use an established and secure hosting service in the United Kingdom. When signing up for one of our packages, we’ll pay for the first year for FREE. We will notify and invoice you towards the end of each hosting year, for an additional years hosting. The invoice total also includes administration costs for general site maintenance for the following year. You are free to cancel at any point, however additional years cannot be refunded once purchased.
Server Disk Space
This is the allocated personal space on Internet given to your site. In most cases, such as ours, 250mb is more than enough for most peoples websites. If you are intending to include a lot of movie o sound content , then you may want to up the size to 750mb.

All of this knowledge is rolled into every project board undertakes, no matter how small.
Custom Graphics and buttons
Well-designed custom graphics such as headers and buttons etc will set your site apart from others as well as making your site a more pleasant environment to visit. We can create a scheme, which is sympathetic to your needs reflecting your personal style or corporate brand, as required.
Text content supplied or commissioned
Having trouble with your written content? With detailed information from you we can commission professional text content or translations. All related commissioning will be quoted for separately and may be under independent terms and conditions.
Images supplied or commissioned
You may or may not already have all the images you need for your site. We can fix this for you one of three ways. Purchase from on-line image libraries, commission a third party illustrator, photographer or artist for example, or produce in house. With a huge range or resources, we can source exactly what you need. All related commissioning will be quoted for separately and may be under independent terms and conditions.
Package Web Page Allowance
Within our package costs is an allowance of FREE web pages with which to construct your site. Additional pages are charged per page and generally ordered along with a package if required. You will find the cost of additional pages in the ‘Option Extras’ section below.
Optional Contact form setup
Contact forms can be useful when you want to get information from your visitors, or when you don’t want to reveal your contact details. On the other hand, these forms can be annoying and tedious.
Custom Flash® Content
Though a lot can be achieved within the boundaries of a standard site programming, it does have its limits. We can use Flash to create custom animations, interactivity and sound to buttons and pages, which can bring your site to life. We find that this can be used very subtly and create stunning results.
Stand Alone Flash® site option
Flash content being used more and more these days to ad animation and interactivity to websites. Stand alone Flash sites are also becoming more popular due to improvements in Flash 9 technology however it does have its downsides. While Flash sites have these downsides, we recommend that if you wish to ad these levels of interactivity etc, that you offer it as an alternative, sitting on the web along side a more conventional and accessible version of your site.
Favicon (favorites icon graphic)
A favicon (short for 'favorites icon'), also known as a website icon or page icon is a small graphic associated with a particular website or page. We can create these in several ways, and many more modern web browsers can then make good use of them. Browsers that support them may display them in the browser's address bar next to the site's name, in lists of bookmarks and next to the page's title in a personal favorites list.
FREE site optimization
We can do a lot our end to give your new site the best chances of being scanned by search engines such as Google. For a start we only use established server networks, which we know to be scanned regularly by all the major search engines. We can also write into your site, meta-tags or keywords that these search engines will look for when scanning your site. Although BOARD cannot guarantee that any Search Engine will index or list any web pages or sites created, we will do our utmost to ensure that your site is optimized to the best it can be.

EMAIL
Business email address.
This is a POP3 email account held on the web server and relates to your website’s domain name. for eg: yourname@yourbusinessname.com. You can set this up to work on your computer and/or PDA using mail software such as Microsoft’s Entourage or Apple’s Mail. The server will then push all your mail direct to your computer.
Webmail option
Enables you to also access your business mail account on-line, which is handy when you are away from your computer.

OPTIONAL EXTRAS
Cost per Additional Page
This is the cost per page exceeding the package allowance, and should be added when ordering your website. Pages added later, after the completion of your site, will be quoted for separately. Think about how many pages you really need and plan your website carefully from the outset, this will save you money in the long term.
Additional annual hosting
We charge for hosting per year and will invoice you once per year for the service. You are free to cancel at any point, however additional years cannot be refunded once purchased. This fee also includes administration costs for general site maintenance.
Basic Update fee.
From time to time you may find that you need to update the content on your site. We offer this service at a fixed rate to make this as accessible and simple as possible. Basic Updates only include swapping the contents of existing text and image areas on your site and does not include the adding of addition fields. This can be done by downloading our ‘basic site update’ form, filling it in and emailing it back to us along with your new edited content, we’ll do the rest. For more major site updates, we’ll provide you with a quotation in advance.
